Terms and Conditions

By making a purchase or rental booking with BLUSH FLOWER CO. (“The Business”), the customer (“The Customer”) agrees that he/she/they understands and accepts the following Terms and Conditions:

Booking and Payment: If the booking is made more than 60 days before the pick up date, a 50% non-refundable deposit is due at the time of booking. The total booking cost is due 60 days prior to the pick up date. Failure to pay the balance by the due date may result in the cancellation of the booking.

Rental Pick Up: The Customer acknowledges that they are responsible for picking up and returning the rental items from The Business located in Ottawa, ON, however the Customer can request a quote for delivery, installation and pick up services. Pick up and return times must be arranged with The Business in advance and be done during business hours of 9AM and 6PM, unless otherwise agreed.

Rental Conditions and Restrictions: The Customer agrees to return all rental items to the Business by the rental Return Date. Late returns not agreed with the Business are subject to a charge of up to 25% of the total rental cost, charged per day the rental is late, up to a maximum of four days, at which point the item is considered lost.

The Customer further agrees that the rented property shall [1] not be left outdoors overnight or unattended; [2] not be used near an open flame; [3] be protected from rain/water/liquid/snow; [4] not be stored or used in an area where smoking is permitted; [5] not be used near a campfire while a fire is lit (due to lingering smoke odour).

Damaged and/or lost rental items: The Customer shall be responsible for the items damaged beyond repair (as determined by the Business) and/or unreturned items, estimated at up to 200% of the rental cost of the item, however this amount may be higher for certain items with a high replacement cost or extensive repair time.

Credit Card Authorization: The Customer authorizes the Business to take a copy of their credit card information and the Customer agrees that payment of any damage/loss fees can be charged to the Customer’s credit card on file.

Rental Bouquet Restrictions: The Customer agrees that rented bouquets will not be tossed or thrown, e.g. during a bridal bouquet toss event at a wedding. A toss bouquet can be purchased, if desired by the Customer.

Cancellation policy: Cancellations can be made up to 60 days before the rental Pick Up Date and must be submitted via email to hayley@blushflowerco.ca. Any deposit paid at the time of booking is non-refundable. In the event that a refund is issued, the amount of the refund will be reduced by any credit card processing fees incurred by The Business for the original payment and/or the refund transaction.

Changes to Items Rented: Changes to items in an existing order can be requested up to 21 days prior to the Pick Up Date by emailing hayley@blushflowerco.ca. Change order requests are subject to availability and potential additional charges. Exchanges must be at equal or greater value. Cancellations of individual rental items are subject to the cancellation policy stated above.

Changes to the Rental Period: A change in rental dates may be requested by emailing hayley@blushflowerco.ca. Date changes are subject to availability and agreement of the Business. In the event that rented items booked for the original Rental Period are not available for the revised Rental Period, the amount paid can be used towards other available items. 

Rental Modifications and Substitutions: Due to the handmade nature of the rental items and potential customizations we make per booking, the items rented may vary slightly from those pictured on our website. The Business reserves the right to modify or substitute a rented item if needed, however, the substitution will be as similar to original item as possible.

Indemnity: The Customer indemnifies the Business harmless against any and all liabilities, claims, and expenses (including legal fees), arising from the Customer’s use of products and services provided by the Business.

Default: In the event of non-payment or other breach of these Terms and Conditions by Customer, the Customer shall pay all costs and expenses incurred by the Business in connection with enforcement of the Terms and Conditions including any legal fees.

Force Majeure: In the unlikely situation that The Business is unable to fulfil the services/products in the rental booking due to acts of God, fire, flood, war, epidemic, pandemic, natural disasters, weather, terrorism, crime, revolution, riots, labour disputes, accidents, civil disorder, government acts or regulations, or any extraordinary event or circumstance beyond the control of one or both parties, a credit for a future booking will be issued to the Customer (minus any products/services rendered).
